This is an appropriate threshold for this aspect of the power since exercising it will often involve a choice between different policy options about how best to address the deficiency. For example, a deficiency would exist where a function was currently exercised by an EU institution; there would therefore be a policy choice about the most appropriate Scottish public authority to take on that function, or whether a new Scottish public authority should be established for that purpose.
