As the issue is technical, I am happy to submit a note to the committee, but I will outline the matter briefly. Transfers of undertakings are, as the committee knows, governed by the Transfer of Undertakings (Protection of Employment) Regulations—which are referred to as TUPE.

My background is in housing and for many years people with such a background have pointed out that there was a mechanism to transfer cash to meet the transfer responsibilities from what was called in the old days the Department of Social Security to local authorities—the care element transfer—and that there was a mechanism to deal with the transfer of health responsibilities to local authorities—the resource transfer for revenue-based services—but there was no equivalent mechanism for capital transfer; there was no capital resource transfer.

As time has gone on, there have been increasing concerns about resource transfer. The benefit of that first tranche of money was a reduction in in-patient bed days for the elderly, and there are concerns that there is insufficient resource transfer from the acute sector to the primary and social care sectors.

To ask the Scottish Executive why the free advertising of contact details for Visitscotland.com, which is contained within almost every document produced by VisitScotland, does not breach European State Aid rules. The visitscotland.com website - the website for Visit Scotland - provides a range of information on visiting Scotland and the reference to the website in Visit Scotland publications is in line with standard practice for both commercial and non-commercial organisations in providing details of how to find more information.

The amendment refers to a "lasting legacy", but the Executive has created a legacy of bureaucracy and barriers to trade, which 46 per cent of the business community want to do away with and about which 26 per cent are neutral. I hope that this debate moves that 26 per cent forward into the camp that wants more change...
