Age of Criminal Responsibility Scotland Bill as Amended at Stage 2

P ART 5 F INAL P ROVISIONS 25 64 Interpretation In this Act— “2011 Act” means the Children’s Hearings (Scotland) Act 2011, “child” means a person who is under 16 years of age (except where provided otherwise: see section 31(3)), 30 “constable” has the same meaning as in section 99(1) of the Police and Fire Reform (Scotland) Act 2012. 65 Civil jurisdiction of summary sheriffs (1) The Courts Reform (Scotland) Act 2014 is amended as follows. (2) In schedule 1 (civil jurisdiction of summary sheriff), after paragraph 4 insert— 35 “Proceedings relating to children under the age of criminal responsibility 4A Proceedings under the Age of Criminal Responsibility (Scotland) Act 2018.”. 44 Age of Criminal Responsibility (Scotland) Bill Part 5—Final Provisions 66 Regulation-making powers (1) Each power of the Scottish Ministers to make regulations under this Act includes power— (a) to make different provision for different purposes, 5 (b) to make any incidental, supplementary, consequential, transitional, transitory or saving provision which they consider appropriate. (2) Regulations under the following provisions are subject to the negative procedure— (a) section 18(1), (b) section 24(1), 10 (c) section 54(2)(b)(iii), (d) section 54(3), (e) subject to subsection (3)(e), section 67. (3) Regulations under the following provisions are subject to the affirmative procedure— (za) section 4B(4), 15 (a) section 19(1), (b) section 25(4), (c) section 49(6), (d) section 55(9), (e) section 67 which add to, replace or omit the text of an Act. 20 (4) This section does not apply to regulations under section 68(2). 67 Ancillary provision (1) The Scottish Ministers may by regulations make such incidental, supplementary, consequential, transitional, transitory or saving provision as they consider appropriate for the purposes of, in connection with or for giving full effect to this Act or any 25 provision made under it. (2) Regulations under subsection (1) may modify any enactment (including this Act). 68 Commencement (1) This section and section 69 come into force on the day after Royal Assent. (2) The other provisions of this Act come into force on such day as the Scottish Ministers 30 may appoint by regulations. (3) Regulations under subsection (2) may— (a) include transitional, transitory or saving provision, (b) make different provision for different purposes. 69 Short title 35 The short title of this Act is the Age of Criminal Responsibility (Scotland) Act 2019.
