An Executive amendment at stage 3 will insert a new section after section 42 to deal with the cross-border transfer of prisoners. The new power will be subject to affirmative procedure and enables provision to be made for the transfer of prisoners out of and into Scotland.

When are we going to get those transfers? The letter from Malcolm Chisholm, which is available on the Communities Scotland website, makes it clear that, between now and the summer, ministers and Communities Scotland will be working with GHA to identify and support any organisations that are able to move forward to second-stage transfer under the current arrangements.

Is there any prohibition on the use of the normal rules of freedom of contract in commercial leases, which would transfer the liability in the same way that a landlord ensures that all rates assessments and so on are transferred to a tenant?
