Scottish Government Response to Police Ethics Bill Stage 1 Report

Under section 1 of the Inquiries into Fatal Accidents and Sudden Deaths etc (Scotland) Act 2016, the COPFS is required to investigate where an inquiry is to be held into the death of a person in accordance with sections 2-7 of the relevant Act. Sections 2-7 include when there is either: • a mandatory inquiry (such as where a person dies in the course of their employment or occupation or where they die in custody), OR • a discretionary inquiry (where a death was sudden, unexpected or unexplained or occurred in circumstances giving rise to serious public concern and the Lord Advocate decides it would be in the public interest for there to be an inquiry).

Stage 1 report: Assisted Dying for Terminally Ill Adults (Scotland) Bill - Coercion

In relation to coercion, these included: clarity on how the coordinating doctor should assess that a declaration was made voluntarily and free from coercion; no requirement for the coordinating doctor to involve any other agencies when assessing coercion or abuse; and clarity on whether the doctor or nurse should be in the same room as the person or not when they die and whether other people can be present with the person when they die.17Police Scotland.
