The European Court of Human Rights has found that Article 8 does cover the right to decide when and how to die. However, it has held that states have significant discretion in how this right is controlled – referred to as a wide “margin of appreciation”.

While the EFW Committee is the appropriate committee from a policy perspective, and the Session 5 Economy Committee had undertaken some work in relation to moveable transactions and the SLC’s report, the current EFW Committee did not scrutinise the Moveable Transactions (Scotland) Bill.

To take an example, where debts have been assigned in a bulk assignation transaction, it is highly unlikely that the debtor’s name will be on the register.
