UK Withdrawal from the European Union (Legal Continuity) (Scotland) Bill as Amended at Stage 2

P ART 5 P UBLICATION AND RULES OF EVIDENCE 15 Publication of retained (devolved) direct EU legislation etc. 23 Duty to publish retained (devolved) direct EU legislation etc. (1) The Queen’s Printer for Scotland must make arrangements for the publication of, so far as devolved— (a) each relevant instrument that has been published before exit day by an EU entity, 20 and (b) the relevant international agreements. (2) In this section— “relevant instrument” means— (a) an EU regulation, 25 (b) an EU decision, and (c) EU tertiary legislation, “relevant international agreements” means— (a) the Treaty on European Union, (b) the Treaty on the Functioning of the European Union, 30 (c) the Euratom Treaty, and (d) the EEA agreement. (3) For the purposes of this section, a relevant instrument or relevant international agreement is devolved if and to the extent that it makes provision that would be, if it were contained in an Act of the Scottish Parliament, within the legislative competence 35 of the Scottish Parliament. (4) The Queen’s Printer for Scotland may make arrangements for the publication of— (a) any decision of, or expression of opinion by, the European Court, or 20 UK Withdrawal from the European Union (Legal Continuity) (Scotland) Bill Part 5—Publication and rules of evidence (b) any other document published by an EU entity. (5) The Queen’s Printer for Scotland may make arrangements for the publication of anything which the Queen’s Printer for Scotland considers may be useful in connection with anything published under this section. 5 (6) This section does not require the publication of— (a) anything repealed before exit day, or (b) any modifications made on or after exit day. 24 Exceptions...
