The White Paper states that it is very rare for the Supreme Court to deviate from one of its own decisions, so suggesting that it is unlikely that the case law of the CJEU will be re-visited by the Supreme Court, though the possibility of doing so remains:

I believe firmly that if we are consulting some of the business organisations in Scotland, such as the Federation of Small Businesses or Scottish Enterprise, there will be much merit in trying to conjoin that with a visit to a member of the business community or to a workplace.
