Impact of this Act on prisons 14A Impact of this Act on prisons (1) The Scottish Ministers must, no later than three years after section 2 comes into force, 30 prepare and publish a report on the impact of this Act on the placement of transgender people within prisons. (2) A report under subsection (1) must set out, in particular, any change in the number of— (a) trans women residing in women’s prisons, (b) trans women residing in men’s prisons, 35 (c) trans men residing in women’s prisons, (d) trans men residing in men’s prisons. 21 Gender Recognition Reform (Scotland) Bill Review of time periods 14B Review of time periods (1) The Scottish Ministers must, no later than three years after section 2 comes into force, prepare and publish a report on a review of the impacts on trans people of— 5 (a) the period a trans person is required to live in the acquired gender under section 8C(1)(a)(iii) of the 2004 Act (inserted by section 4), (b) the reflection period under section 8B of the 2004 Act (inserted by section 3). (2) The report under subsection (1) must set out any changes that the Scottish Ministers propose to make to the time periods as a result of the review. 10 Reporting on gender recognition 1 15 Registrar General’s duty to report (1) The Registration of Births, Deaths and Marriages (Scotland) Act 1965 is amended as follows. (2) In section 1 (the Registrar General), in subsection (4), after “relates” insert “, the 15 information mentioned in subsection (5)”. (3) After that subsection insert— “(5) The information referred to in subsection (4) is— (a) the number of applications made to the Registrar General in the year to which the report relates for each of the following— 20 (i) a gender recognition certificate under section 8A(1), 8F(1), 8J(1) or 8K(1) of the Gender Recognition Act 2004, (ii) a confirmatory gender recognition certificate under section 8O(1) of that Act, (b) the total number of gender recognition certificates and confirmatory 25 gender recognition certificates issued by, or received from the Court of Session or a sheriff clerk by, the Registrar General in that year, (c) of those certificates, the number which are— (i) full gender recognition certificates, (ii) interim gender recognition certificates, 30 (iii) confirmatory gender recognition certificates. (6) But the Registrar General is not required to include any information mentioned in subsection (5) in the report if the Registrar General considers that the inclusion of that information (by itself or in combination with other information) would allow a person who applied for, or was issued with, a gender recognition 35 certificate or a confirmatory gender recognition certificate to be identified.”. (4) In section 56(1) (interpretation), after the definition of “function” insert— ““gender recognition certificate”, “confirmatory gender recognition certificate”, “full gender recognition certificate” and “interim gender recognition certificate” have the meanings given by section 25(1) of the 40 Gender Recognition Act 2004,”. 22 Gender Recognition Reform (Scotland) Bill Impact of Act on Equality Act 2010 1 15A Impact of Act on Equality Act 2010 For the avoidance of doubt, nothing in this Act modifies the Equality Act 2010.
