Trustees’ duties to provide information
Sections 25 and 26 of the Bill set out the duties of trustees to provide certain information about the trust to beneficiaries and potential beneficiaries.
As you are aware, the Committee has been considering the evidence gathered during its Stage 1 scrutiny of the Bill. At its meeting on 26 April 2023 the Committee agreed to write to you as the Member in Charge and the Scottish Government in advance of finalising its Stage 1 report.

Through that process FCS negotiated market leading rates of community benefit of £5,000 per megawatt installed per year (index linked) to be shared by local communities.
The Scottish Government published its Budget 2025-26 on 4 December, and the Committee received a response from the Minister for Equalities to its recommendations.
The Scottish Government is committed to engaging with people with experience to co-design the detail of the new NCS system, to finalise new structures and approaches to minimise the historic gap between legislative intent and delivery.
