Currently, where one of the circumstances that are set out in section 10(2) applies, it seems unlikely that a claim of reasonable belief in consent on behalf of the accused would be credible in anything other than exceptional cases. To widen the circumstances that are set out in section 10(2)(c) to include vague but potentially common circumstances would risk such an outcome being the rule, rather the exception, potentially weakening the provisions in relation to the other circumstances that are covered in section 10(2).The Government's view is that amendment 132 extends the circumstances that are covered by section 10(2) in a way that is inappropriate and risks undermining the intent behind the amendment.
