Delegated powers in the Natural Environment (Scotland) Bill (as amended at Stage 2)
While it would be theoretically possible to carve out an exception to provide that scallop shells were not to be treated as waste in any circumstances, it is not clear to the Committee that such a provision would resolve the practical issues the member who lodged the amendment containing this power seeks to address.
