The Minister noted the concerns and reassured Members that discussions were being held with the Medicines and Healthcare products Regulatory Agency (MHRA), and that it was a reserved matter. The Minister expressed a further offer to discuss mitigations to the impact on businesses ahead of Stage 3.

Stage 1
In its Stage 1 Report, the Criminal Justice Committee expressed support for the principle of the provisions in this area, but sought reassurance on two issues:

The Minister and his officials were not aware of the DPLR Committee’s comment regarding a duplicate paragraph 32AAA but stated that “it may be possible to deal with this as drafting points” during the passage of the Education (Scotland) Bill.
The Committee expressed disappointment in the lack of detail contained in the policy note.
In relation to the first bullet point above, a specific expression of this general rule can be found in the 1985 Act in relation to Principle 1 (fair sharing of matrimonial or partnership property).
