Prior to making such regulations, the Scottish Ministers are required to consult the Chief Constable of Police Scotland, the Lord Advocate and the Lord Justice General.
Section 56(1) of the 2012 Act gives all constables a right to appeal to the Police Appeals Tribunal (PAT) against any decision for dismissal or demotion.
Background
Currently, while the 2012 Act allows functions to be conferred on the PIRC in relation to the investigation of whether any constable has been engaged in misconduct, this has only been done for senior officers (the rank of Assistant Chief Constable and above) through their Conduct Regulations.
Section 19(2) of the Wildlife and Countryside Act 1981 gives a specific power to constables to enter premises other than a dwelling if the constable has reasonable cause to suspect that any person is committing or has committed an offence under Part I of the Act.
The Sub-Committee agreed to write to the Cabinet Secretary for Justice and the Chief Constable to seek their views on the issues raised during the evidence taking session.
