I also have no doubt that if the possible apportionment of a BID levy is a feature of the secondary legislation that will flow from the bill, new commercial leases for commercial property in Scotland will make it quite explicit that the tenant has to pay the landlord's share.In that case, the Scottish Executive will be able to enforce payment of the landlord's share of a BID levy only by making it explicit that it is illegal to contract out of that provision.
