When the bill that became the 2004 act was first introduced, there was a best interests test, which was not well received because, at that point, Scotland was moving away from that kind of approach to the exercise of children’s rights—although I would note that we have now incorporated into Scots law the United Nations Convention on the Rights of the Child, which includes a best interests test.
