Provision
At present, under the Tobacco and Primary Medical Services (Scotland) Act 2010 (“the 2010 Act”), it is a defence for someone who is charged with an age of sale offence in Scotland that they believed the customer was over the age of sale and that they took reasonable steps to establish the customer’s age.
