It is against such a return that investment proposals across the UK are judged and assessed.I have absolutely no doubt that, as drafted, most commercial property leases already attribute responsibility for full payment of a BID levy—both the landlord's share and the tenant's share—to the tenant. I also have no doubt that if the possible apportionment of a BID levy is a feature of the secondary legislation that will flow from the bill, new commercial leases for commercial property in Scotland will make it quite explicit that the tenant has to pay the landlord's share.In that case, the Scottish Executive will be able to enforce payment of the landlord's share of a BID levy only by making it explicit that it is illegal to contract out of that provision.

If a property was repossessed because, under the Antisocial Behaviour etc (Scotland) Bill, the landlord received no rent and therefore could not pay the mortgage, what would happen to the sitting tenants? Would the lender have to register as the landlord?
