Establishing clearer and faster pathways for displaced individuals to secure new sponsorship could reduce uncertainty, retain these skilled workers, which would help alleviate staffing pressures across Scotland’s health and social care sectors.
This suggests that monitoring and regulating use of the new powers will be challenging. The difficulty of ensuring oversight of this power ought to be considered in assessing the proportionality of the new rule.
