The power to add the characteristic of sex is subject to what is commonly referred to as a ‘super affirmative procedure’. In this case, that requires that a proposed draft is laid before the Parliament for a period of 40 days before a draft can be laid.
Where a bill proposes the delegation of a broad power, the Scottish Government should think about using an appropriate super-affirmative procedure to improve parliamentary scrutiny of how the power is used.
In particular, the trend towards the ‘super-schools’ we now see across Scotland creates an environment that conflicts with sensory differences experienced by autistic people.
Consumers would be enabled under the scheme to return the containers to any retailer selling drinks covered by the scheme and redeem the 20p deposit.
The instrument is subject to a “super-affirmative” procedure. At this stage the draft Regulations are only laid for consultation purposes.
