European sites are internationally important areas for threatened habitats and species - and their designation creates legal objectives to work towards their favourable conservation status (FCS).
Following the 2018 Act, the powers and duties held by the Commissioners were transferred to Scottish Ministers (where they relate to Scotland). Two new organisations were established to replace FCS: Forestry and Land Scotland, and Scottish Forestry.
Yet, throughout the application process and the appeal, data from the FC was not requested which would have informed the Reporter of this significant lacuna.
