The latter includes provisions that will require the Scottish Ministers to make a determination on whether the information should be provided to a child victim, and this includes consideration of their age and maturity, views and their best interests. These provisions introduce discretionary decision-making by Ministers into these areas, and we are proposing that this kind of critical decision-making be supported by a Code of Practice, to be inserted into the Criminal Justice (Scotland) Act 2003 in new section 18ZA.
