“Overseas gender recognition” means legal gender recognition obtained in a country or territory outwith the United Kingdom (subsection (3)(a)). 9 There is a limited exception. Section 21(6) of the GRA currently provides some acknowledgement of the need to recognise gender recognition obtained elsewhere in the European Union.
The Scottish Government has dismissed the findings of Dr Hilary Cass’s interim review as not being relevant to Scotland, which is contrary to the stance taken by the First Minister in comparing NHS England with NHS Scotland when answering questions at First Minister’s question time.
This removes an otherwise useful remedy from children who wish to make use of their rights and can lead to matters escalating to even more formal and adversarial forms of dispute resolution unnecessarily. As the exception is contained within regulations, it would be straightforward for Ministers to remove or amend the exception.
