The Regulations are subject to the negative procedure and will come into force on 12 August 2019, except for regulation 21 and schedule 2 (both of which deal with revocations) which come into force on 31 March 2020.
The key elements of NDR are:
Rateable values are set by independent Assessors on the basis of market value every five years, except the 2017 revaluation, which was seven years after the last one.
Specifically, this Order:
transfers the property and liabilities of the Forestry Commissioners in Scotland to the Scottish Ministers (with certain exceptions);
enables agency arrangements to be entered into under which the UK Government can exercise specified functions on the Scottish Ministers’ behalf.
If the backstop is implemented, there will be no tariffs, quotas or checks on goods, with the exception of fishery and aquaculture products, “unless an agreement on access to waters and fishing opportunities” is agreed.
