Amendment of Law Reform (Contributory Negligence) Act 1945 22 Amendment of Law Reform (Contributory Negligence) Act 1945 In section 5 of the Law Reform (Contributory Negligence) Act 1945— (a) in paragraph (a), after “; and” insert “subject to paragraph (aa)”, and 25 (b) after paragraph (a) insert— “(aa) without prejudice to the generality of section 1— (i) in subsection (1) of that section the reference to a person’s “own fault” includes a reference to that person’s breach of a contract and the reference to “the fault of any other person or persons” 30 includes a reference to a breach of a contract by that other person or those other persons; and (ii) in each of subsections (2), (5) and (6) of that section, references to being “at fault” are to be construed accordingly;”. 11 Contract (Formation and Remedies) (Scotland) Bill Part 3—General P ART 3 G ENERAL 23 Saving The provisions of this Act are without prejudice to any enactment or rule of law which— 5 (a) regulates any question which relates to— (i) the formation of a contract, (ii) mutuality of contract, or (iii) remedies for breach of contract, but is not provided for by the provisions of this Act, 10 (b) requires writing for the formation of a contract, 1 (c) prescribes a form for a contract, (d) regulates any question which relates to the essential validity of a contract, (e) provides protection against unfair contract terms, or (f) provides protection for a particular category of contracting person. 15 24 Ancillary provision (1) The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, in connection with or for giving full effect to this Act or any provision made under it. 20 (2) Regulations under this section may— (a) make different provision for different purposes, (b) modify any enactment (including this Act). The Royal Environmental Health Institute of Scotland submission non surgical procedures order

As a result, there will be premises that require both licences, for example where tattooing and laser tattoo removal are carried out, or where a beautician provides electrolysis and semi- permanent make-up (licensed under the Skin Piercing Order) alongside microneedling and IPL hair removal (which would require the new licence). This will result in two separate visits by Environmental Health Officers to process the licences and will effectively double the cost for affected businesses.
