This section requires that negative instruments are laid at least 28 days before they come into force and this instrument would only be laid for 27 days before coming into force.
On 26 November 2020, the Scottish Government wrote to the Presiding Officer explaining why the 28-day rule was not complied with.
A total of 88 responses were received, 26 from roads authorities, 15 from utility companies, 10 from contractors, 8 from special interest groups, 16 from individuals and 13 classed as "others".
Technical decisions on those matters are made solely by the UK Government. The latest data includes, for the first time, the impact of the historical drainage and rewetting of peatlands.
However, Defra as the secretariat for UK National Plant Protection Organisation (NPPO) will be writing to the third country NPPOs to inform them of the new requirements before NID/021 comes into force.
