At its meeting on 26 September 2023, the DPLR Committee considered the instrument and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.
Offence of failure to protect from FGM
Section 72 of the Serious Crime Act 2015 created a new offence in England, Wales and Northern Ireland of failing to protect a girl under the age of 16 from the risk of FGM.
The decision was then taken that the farm would be put on the open market, subject to a criteria or protocol that we developed early on in the new business around farm sales. Open-market sales do not happen frequently in the Scottish business.
In Scotland, we know that a wide range of reuse activities already take place, from formal redistribution networks to informal sale or exchange. However, we currently have no way to monitor the type, volume or impact of this activity.
There were views that leaving out the registration process would increase the risk of disputes and contested sales, for instance in relation to the boundaries of tenanted land, which is meant to be settled during the registration process.
