If the civil servants working for the minister genuinely believe that things that alter or have an on-going effect on our legal system are not of importance, the Scottish Executive should think about employing someone new. Enlargement and the European Council in Seville are matters that have a clear devolved content.

I do not quite see Iain Smith's argument against the proposal. He thinks that the new wording would introduce unclarity, but surely there is unclarity at the moment, which is what is causing the dispute between the two lots of lawyers.
