In family actions in the Court of Session, I have recent experience of using the provisions of the Vulnerable Witnesses (Scotland) Act 2004 to adopt the same sorts of special measures that we routinely use in the High Court—such as the use of screens, the presence of a supporter and evidence being given through a live link.
The Scottish Government provided further information in relation to the formation of a UK-wide group, which “will share expertise and develop UK wide guidance and recommendations” to “ensure a consistent approach to screening and surveillance”. The petitioner and OcuMel UK have queried the benefit of such a group.
