I do not quite see Iain Smith's argument against the proposal. He thinks that the new wording would introduce unclarity, but surely there is unclarity at the moment, which is what is causing the dispute between the two lots of lawyers.

I can confirm that the figure of £10 million simply represents a transfer from the capital revenue accounts of the Executive to cover that new expenditure. Where is the disappearance of the £10 million from the capital budget shown?
