Because the liberty of the individual is at stake, the courts will be very strict in their assessment of how much leeway is permitted to the police on this matter.I have no doubt that the courts will interpret the phrase in section 4(6) as requiring the police to intimate to the fiscal almost immediately after the arrest and just as soon as it is feasible to get in touch with the fiscal. The sensible discretion that is given to the police does not in any way affect the protection that is available to the alleged abuser, nor does it delay their appearance at court.
