It is my view that the introduction of the consideration of unnecessary suffering affords the prosecution service and the courts, in passing sentence, an opportunity to scale offences by severity, on the basis that an offence that involves a gross degree of unnecessary suffering would provide justification for imposing the maximum penalty.
