I emphasise the European convention on human rights angle on the regulations. It is important that we get our points clarified. There are more errors than we would have hoped to find had the regulations been properly checked and rechecked before they came before us.
If the committee has a doubt about who is covered by the order, we can be sure that someone is going to try and drive a coach and horses through it in order to get round it. Again, helpful is good, so let us have the drafting as clear as possible.
The enabling power was not in place when the order was made. The Executive is just getting ahead of itself. The problem is just a kink in the regulations that we should point out.
We all know that we have a great deal to say on delegated powers if the drafting team does not get them right. Political points could be made about the bill, but, as far as subordinate legislation is concerned, the bill seems to be clean and pure.
That is in spite of the minister's letter telling us that it was the best thing since sliced bread. Yes, but we will get another instrument. Members will be equally surprised to learn that there was a mistake in the instrument's drafting, which is why it has been revoked.
