The committee asked for an explanation of that order-making power and, as a result, two Executive amendments were introduced at stage 2. New subsection 33A(3) states that any order under new section 33 will be subject to the affirmative procedure.
There is no scope in the regulation for an absolute derogation and all new vehicles will have to be compliant when the law comes into force on 1 January.

We are considering, alongwith Network Rail, the Strategic Rail Authority and the City of Edinburgh Council, how best to improve Haymarket Station. Better access to the station ispart of that consideration.
