Lindsay Montgomery is shaking his head, but I do not understand why, because at present those people automatically get junior counsel, but under the new system, people will have to meet a set of criteria to get the same representation.Unless you can guarantee 100 per cent that the Crown Office or another body will say that, in cases that would have gone to the High Court but which under the new system will go to the sheriff court, all the rights that would have been incurred in the High Court will apply in the sheriff court—which means that the people involved will automatically get junior counsel—people will get less of a service from the Scottish Legal Aid Board and the legal system.
