In short, the Scottish Government could have added within legislative competence the protected characteristic of gender reassignment, which would have included trans men and trans women. But it created a new protected characteristic of trans women, which it did not have the power to do.

Stage 1 Report on the Gender Recognition Reform (Scotland) Bill - Removal of the requirement for a diagnosis of gender dysphoria and the requirement for medical evidence
The Committee also notes the concerns expressed by some about the potential for abuse of the new process proposed by the Bill.
The majority of the Committee supports the removal of the requirement for any medical evidence or diagnosis, in line with a self-declaration model, believing that trans people know their own minds.
