Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No 3) (Scotland) Order 2004 (SSI 2004/237) Are there any points to raise? I wondered whether the acronym for the Food and Environment Protection Act 1985—FEPA—ought to be written in the upper case rather than the lower, as it is written in the legal brief.
Organic Aid (Scotland) Regulations 2004 (SSI 2004/143) I think that we might have some points to raise on these regulations. Why do we not ask the questions that it is suggested we might usefully pursue with the Executive?
Support and Assistance of Young People Leaving Care (Scotland) Regulations 2003 (SSI 2003/608)Title Conditions (Scotland) Act 2003 (Conservation Bodies) Amendment Order 2003 (SSI 2003/621) We move now to item 2, which is instruments subject to annulment. No points of substance have been identified on the first two instruments.
Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003 (draft) The Executive has acknowledged that this draft order was defectively drafted in respect of almost all the points that the committee raised. The order has been withdrawn and a fresh draft has been laid.
Scottish Secure Tenancies (Exceptions) Amendment Regulations 2002 (SSI 2002/434) No points arise on the regulations. The regulations have been made to come into force on the same day as the defective instrument and therefore break the 21-day rule.
Non-Domestic Rate (Scotland) Order 2002 (SSI 2002/89) No points have been noted on the order, but we could suggest to the Executive, by informal letter, that future orders should indicate the previous rate in the explanatory note or a footnote.
Interests Before we move on to the next agenda item, I should point out that I did not ask the new—or, should I say, recidivist—member of the committee, Phil Gallie, whether he would like to make a declaration of interests.
