Little Loch Broom Scallops Several Fishery Order 2002 (SSI 2002/186) A question came up on this order and on the previous one: Ian Jenkins was very concerned about fishermen who might die. I wondered what would happen to an order that named an individual if that individual then died.
Members will recall that we considered the regulations on 26 September. We had two main concerns about defective drafting and ambiguity of specific parts of the regulations, which had been picked up by the Subordinate Legislation Committee.
The paper is quite short—it has only 12 paragraphs—but a number of points are made. Perhaps the best way of dealing with it is to go through the items in order.Some issues are still outstanding.
