The Law Commission concluded that, for patrimonial loss, the best approach was a fully standardised one that, disregarding relatives’ income, works on the basis that fatally injured individuals would have been spending 25 per cent of their income on themselves and 75 per cent on their family’s requirements.

As I said earlier, I am hearing evidence locally—albeit anecdotal evidence—that sheriffs are prosecuting more people for speeding in the area, so people are either forgetting the new speed limit or they are getting used to it.
First, there are issues about applying legislation retrospectively, which is not regarded as the best approach. We should legislate from our point in time.

We are increasing public confidence by improving the system. The new community payback order, which comes into force on 1 February, will be clearer, tougher and more effective than the community disposals it will replace.

To ask the Scottish Executive whether it has sought the advice of Marine Scotland on the environmental implications of introducing a moratorium on new leases for wave and tidal energy developments in Orkney waters and the Pentland Firth and, if so, what advice it has received.
