If the report took account of the European legal situation, there is no point in pursuing the matter. I am not sure whether that point has been checked.
However, what if one of my best staff, who heads up a department that is leading cutting-edge research that is gaining maximum points through the RAE, asks me whether there is any chance they can go on secondment for three years because they quite fancy setting up their own business?
