Speaking to Amendment 133, Nicola Sturgeon stated that the new provision:
... ensures that young people who return to care or accommodation are eligible for continuing care on the same basis as those who never left care.
Amendment 15 would require Ministers to insert a new section into the 2007 Act requiring Ministers to make regulations setting out a definition of ‘adoption breakdown’ and guidance on the collection and sharing of information.
Now that work on participation and deliberative democracy is moving on to a new phase of embedding it throughout the Parliament for Session 7 we believe that the remit of the Committee should return to a focus on petitions in the next session.
Given the success of this approach we recommend it continue into the new Session.
As every petition is considered by the Committee at least once and petitions are often kept open and considered multiple times there can be a significant wait between petition considerations.
In its response, the Scottish Government stated that its intention is to make clear that actions or conduct that took place prior to the commencement of the provisions will not fall within the scope of the new offence, noting that offences under the 2021 Act can consist of a single act or a course of conduct.
