The Scottish Executive's intention, as set out in National Planning Policy Guideline 1 (NPPG 1): The Planning System, is that only applications which raise issues of national significance require to be determined by the Scottish Ministers.
Amendment 85 will remove paragraph 2(2)(b) of schedule 2 to take account of the fact that section 40(1) of the Criminal Justice (Scotland) Act 2003 has been amended with effect from 1 December 2006.
In response to a point that she raised earlier, I confirm that we have no intention of using the power conferred by section 27(6)(aa) to empower the making of subordinate legislation. With my colleagues, I am especially grateful to the members of the Environment and Rural Development Committee for their thorough and helpful consideration of the bill at stage 1 and for their support for the amendments that we lodged at stage 2 in response to their stage 1 report.
As the principle that is detailed in the first bullet point in paragraph 6 of the paper states, any complaints at stages 1 or 2 should be made to the commissioner.
At stage 1, speculation is not a sensible way for any committee to have to do its work and the situation will become even more problematic at stage 2 if we still lack the clarity that we needed at stage 1.
We commend the inclusion of that aim among the main aims, but qualify that commendation by expressing minor concerns about section 8(6), which prioritises paragraph (a) of section 1(3) over the other paragraphs in section 1(3).
