Management of Offenders Scotland Bill Delegated Powers Memorandum
Section 26(4) of the Bill inserts new section 164A into the Mental Health (Care and Treatment) (Scotland) Act 2003 (‘the 2003 Act’) to enable a person who is subject to a compulsion order to apply to the Mental Health Tribunal for Scotland for a determination of their disclosure requirements.
