There is good collaborative practice out there and more streamlined partnerships could lead to cost effective new opportunities. While the Committee recognises the need to respond to new scientific evidence, it considers that any changes to this provision may merit greater parliamentary scrutiny.
This power could only be used in subject areas that were within EU competence. Post-EU, the majority of the new powers are still mainly within former-EU subject areas, but increasingly powers are being conferred in other subject areas which were not within EU competence.
The Bill's Policy Memorandum (para 272) states that:
The objective is to establish the Sexual Offences Court as a new court for Scotland, distinct from existing structures to maximise its ability to deliver targeted, meaningful and enduring improvements in a consistent manner to cases involving serious sexual offences.
It deals in particular with transferring ownership of legal claims via a process called assignation and a new type of loan security called statutory pledge.
Policy 28 provides that:
c) Proposals for new small scale neighbourhood retail development will be supported where the proposed development:
i. contributes to local living, including where relevant 20 minute neighbourhoods and/or
ii. can be demonstrated to contribute to the health and wellbeing of the local community.
Ministerial powers to amend, retain and repeal retained EU law
The Bill confers nine new powers on UK Government Ministers, of which six are conferred also on Scottish Ministers (and Ministers of other devolved administrations).
