Even without tenancy deposit schemes, I would hope that the other arrangements that we are putting in place will mean that the number of incidents of tenancy deposits being unreasonably withheld will decline in future. A test should be applied to determine whether disclosing the information would undermine the ability of the procurator fiscal to operate effectively in future.
