To ask the Scottish Government when the trust provisions within the Trusts and Succession (Scotland) Act 2024 will come into force.
Answer
The following provisions of the Act have come into force
- Section 76 dealing with the effect of divorce, dissolution or annulment on special destination;
- Section 77 involving the rights of succession to intestate estate respectively;
- Section 7, under which an unfit trustee may be removed by the court for the purposes of section 8; and,
- Parts of section 9 concerning removal from office by a majority of co-trustees of a trustee who is no longer a member of a regulated profession or entitled to practice, and who was appointed or assumed to provide professional services in managing the trust, together with sections 13 and 14 by which decisions on the removal of a professional trustee by co-trustees are to be governed for these purposes.
The remaining provisions of the Act will come into force in due course although no decision has been taken about a date for that. The decision on when to commence the rest of the provisions generally is closely related to ongoing work with UK Government regarding the provisions covering the reserved matter of pension trusts.

To ask the Scottish Government how much it spent preparing for the roll-out of its replacement for the Winter Fuel Payment prior to its decision to delay the roll-out until 2025, and what any money was spent on.
Answer
The Scottish Government spent approximately £4.2 million on the preparation to roll out Pension Age Winter Heating Payment between May 2023 and August 2024. This primarily relates to the development of systems to deliver the benefit but also covers costs associated with the public consultation, analysis of responses and relevant publications.
Given the short notice of the change in policy following the UK Government’s decision, DWP will deliver Pension Age Winter Heating Payment this winter ahead of Social Security Scotland delivering in 2025-26.
The systems to deliver Pension Age Winter Heating Payment have been designed and developed in line with the Digital Scotland Service Standards, reusing existing technology where possible, to ensure value for money. The service design and the digital systems developed for launch in Winter 2024-25 will be reused when Social Security Scotland delivers the payment next winter (2025-26), although some changes will be required to reflect the new eligibility rules.

To ask the Scottish Government when the Digital Economy Skills Group last met, and how many times it has met since the start of 2023.
Answer
The last meeting of the DESG was held on 31 October 2024. Although officials from the Scottish Government are invited to attend meetings of the group, the Digital Economy Skills Group is organised by Skills Development Scotland. A request for the number of meetings held since the start of 2023 should be directed to Skills Development Scotland.
