Registers of Scotland is a non-Ministerial Public Body answerable to the Scottish Parliament.

RoS is committed to transparency and accountability to the Scottish Parliament. The principal mechanism is via the Annual Report and Accounts which is independently audited and laid before the Parliament annually, most recently on 7 October 2024.

The Keeper and Accountable Officer give evidence to the relevant subject matter committee on the ARA each year. Beyond that there is continued engagement through monthly written updates to the Committee as well as regular publication of performance data on the RoS website.

The Scottish Government recognises the valuable role of community radio in delivering local news and important information to our communities right across Scotland. We believe that it is vital that there is a network of radio operations to expand and enhance the service provision for Scottish listeners and we will continue to champion a stronger broadcasting sector in Scotland to ensure a diversity of voices in communities across Scotland.

Radio, including community radio, has proven its value to our communities at times when the distribution of important information has been particularly vital, such as during the pandemic. We recognise the importance of a strong broadcasting sector with a mixed range of media sources to provide a diversity of voices, local and independent thinking and to empower communities.

We continue to make the case to the UK Government’s Department for Digital, Culture, Media and Sport (DCMS) for support to radio stations, as we did during the pandemic when we pressed for support for radio and subsequently welcomed the emergency funding for community radio through grants for community radio stations across Scotland and the rest of the UK. Scottish Government officials continue to engage with DCMS to ensure that representation from Scotland is made and DCMS understand the challenges that continue to impact the radio sector in Scotland.

Access to NRS Services is set out in our Public Access Policy - National Records of Scotland (NRS) .

For the range of services delivered by NRS, assessments including the EQIA, Island Communities Impact Assessment and Digital Scotland Service Standard Assessment are undertaken at the point of service change and improvement to help improve accessibility for citizens across all communities.

Registration service fees are set by the Registrar General for Scotland with the approval of the Scottish Ministers under The Registration Services (Fees, etc.) (Scotland) Regulations 2006.

Fees contained within the schedules were last amended in 2010 and 2022. These regulations provide instruction for the charges associated with accessing records through the Scotland’s People website.

The fees for inspecting, searching and issuing copies of any records transmitted to the Keeper of the Records of Scotland are set by the Court of Session with consent of Scottish Ministers under the Act of Sederunt (Fees in the National Archives of Scotland) 2005.

In 2022, the Registrar General for Scotland, with the approval of the Scottish Ministers, increased the fees payable for submission of a marriage notice and submission of a notice of a proposed civil partnership from £30 to £45 per party to the intended marriage or civil partnership.

All other statutory fees have remained unchanged since 2020.

Scottish Government marketing teams do not specify inclusion of any specific media outlets to media agencies who prepare the media strategy and schedules based on audience to ensure advertising is as effective as possible and delivers high levels of reach for the investment. Therefore campaign budget is also a critical factor in media agencies determining whether smaller outlets, which deliver lower levels of reach in general, will be added to a media schedule.

The theft of railway materials is an important issue. It is for the police to enforce criminal laws such as theft and the Scottish Government fully supports the police taking the necessary action to hold perpetrators to account.

In terms of the resale of stolen railway materials, attempts may be made to sell these to metal dealers.

There is a licensing scheme for metal dealers and itinerant metal dealers under the Civic Government (Scotland) Act 1982 (“the 1982 Act”). The Scottish Government has taken action to raise standards within the industry, and make it more difficult for metal thieves to convert the proceeds of crime into cash. These changes were made via the Air Weapons and Licensing (Scotland) Act 2015 (“the 2015 Act”), which amended the 1982 Act, strengthening and modernising the existing regime.

The 2015 Act provided new definitions for metal dealer and itinerant metal dealer, thereby extending the scope of the regime. It tightened record keeping arrangements and required proper identification of customers. It also increased penalties for licensing offences.

In more detail, the 2015 Act raised the penalties for failure to have an appropriate metal dealer or itinerant metal dealer licence, or failure to comply with licence conditions. The maximum penalty on summary conviction for operating without a licence without reasonable excuse, or for operating in breach of a condition of a licence, was increased to a fine not exceeding £20,000 and/or imprisonment of no longer than six months. The 2015 Act also amended the 1982 Act to provide for forms of payment that may be accepted by a metal dealer or itinerant metal dealer. This permits payment by bank transfer or cheque and means cash is not an acceptable method of payment.

RoS is delivering a significant programme of digital transformation and modernisation. This has moved RoS’s registers to the cloud; enabled applications to be submitted digitally; and enabled customers to self-serve digital information from the registers; as well as significantly modernising the internal digital tools used by RoS to process applications.

The Scottish Government sets out the Digital Scotland Service Standards which RoS adheres to and RoS staff have taken part in training and development from the Scottish Government’s Digital Academy.
