To ask the Scottish Executive how it plans to increase access to mental health services for gay and bisexual men.

The Scottish Government sets national policy direction for mental health and provides funding to NHS boards and local authorities to support implementation of policy. The management of local actions in implementing national policy, and decisions on local service planning and delivery, spending priorities, and the contribution of the voluntary sector in this, is the responsibility of relevant local agencies.

NHS boards and their partners are expected to plan and deliver services in line with relevant legislation including the Mental Health (Care and Treatment) (Scotland) Act 2003 which has at its heart fundamental principles to ensure equal access to health care: participation; non-discrimination; respect for diversity; reciprocity; and equality.

The Scottish Government works in partnership with NHS Scotland to ensure that lesbian, gay, bisexual and transgender (LGBT) people’s health needs are met and that LGBT people do not experience discrimination on the basis of their sexual orientation or transgender identity. NHS Scotland has operated a policy of equality impact assessment for LGBT people’s health and wellbeing since 2005 and specific “Fair for All” guidance on responding to the needs of LGBT people has been in place since 2002.

We are currently funding the LGBT Centre for Health and Wellbeing to run a Demonstration Project, in partnership with NHS Lothian. The main aim of the project is to provide learning about how to both increase the reach and improve all services for LGBT people who experience mental health problems, and to enhance the mental wellbeing and resilience of LGBT people.

To ask the Scottish Executive how it encourages employers to train staff in ending discrimination and bullying against lesbian, gay, bisexual and transgender (LGBT) people.

The Equality Act 2010 (Specific Duties) (Scotland) Regulations 2012, which came into force on 27 May 2012, require listed public authorities to take steps to gather information on the composition of their employees and on the recruitment, development and retention of employees. This includes taking steps to gather information with respect to the relevant protected characteristics, including sexual orientation and gender reassignment, of employees. Authorities must then use the information gathered to better perform the public sector equality duty and report on the progress they are making. These Regulations therefore encourage most public sector employers to tackle discrimination and bullying against lesbian, gay, bisexual and transgender employees.

In addition, we are providing funding to Stonewall Scotland for their Good Practice Project which works with public employers to provide practical and targeted support to achieve LGBT equality in the workplace.

To ask the Scottish Executive what training NHS boards provide to tackle discrimination against gay and bisexual men by GPs and other health professionals.

NHS Education for Scotland (NES) has worked with Stonewall Scotland to ensure that the needs of all lesbian, gay, bisexual and transgender (LGBT) communities are considered in the development and provision of training and education for NHSScotland. Part of this work saw the development of ‘Good LGBT Practice in the NHS’ and an associated training programme that aimed to support the NHS to develop this good practice across their service areas. In addition NES has developed a CD rom based resource “Addressing LGBT Health Inequalities”.

An innovative pilot programme on assessing cultural competence of trainees in Dentistry explicitly addressed homophobia in the assessment. NES are currently exploring options to build on this work to embed a sustainable approach to assessing cultural competence in vocational training. In addition, NES will be participating in the public sector good practice programme and are developing a bank of case studies and scenarios for use in education and training.

Any individual who feels they have suffered from discrimination in their healthcare can express their right to make a formal complaint under the NHS Complaints Procedure.

To ask the Scottish Executive what its position is on Stonewall Scotland's Gay and Bisexual Men’s Health Survey Scotland report.

The Scottish Government acknowledges the publication of this report by Stonewall. A formal response to Stonewall was issued on 28 May outlining a number of work programmes which relate to the recommendations. These programmes include rolling out health inequality impact assessments and the Lesbian, Gay, bisexual and transgender (LGBT) Demonstration project in Lothian.

The report findings and recommendations have also been drawn to the attention of NHS Health Improvement Scotland as it has responsibility for supporting healthcare providers in Scotland to deliver high quality, evidence-based, safe, effective and person-centred care.

To ask the Scottish Executive whether funding from early intervention programmes and the Change Fund will be used to support and provide services for children and families of prisoners.

The Early Years Change Fund signals a decisive shift to preventative spending in the Scottish budget - rebalancing care, support and service provision towards prevention and early intervention. How this is spent will be subject to local decisions between delivery partners based on guidance from the Early Years Taskforce.

Separately, the Scottish Government provides funding to Families Outside, a national charity in Scotland that works solely to support the children and families of prisoners.

To ask the Scottish Executive how it plans to improve access to mental health officers in the west of Scotland.

Section 32 of the Mental Health (Care and Treatment) (Scotland) Act 2003 places a duty on local authorities to appoint a sufficient number of Mental Health Officers to discharge functions under the relevant legislation. It is for local authorities to decide on the number of Mental Health Officers appointed in their area taking into account local needs and circumstances.

The most recent Mental Health Officers Survey, published in June 2011, show that the number of MHOs within the West of Scotland is at the highest for the past five years.
