To ask the Scottish Government, further to the answer to question S5W-04307 by Keith Brown on 10 November 2016, what other sections of the M8 will have acoustic barrier fencing erected on them.
Answer
The Transportation Noise Action Plan identifies six candidate noise management areas (CNMAs) on the M8, at Livingston, Blackburn, Whitburn, East Whitburn and Kirk O’Shotts. Each CNMA will be reviewed to determine if it should become a Noise Management Area (NMA) with this review due to be completed at the start of 2017. NMAs are locations where noise management interventions (including, but not limited to acoustic barrier fencing) could be applied on a prioritised basis during existing maintenance and improvement programmes, where reasonably practicable.

Noise monitoring will be undertaken 12 months after the opening of the new road. To ask the Scottish Government from which budget the provision of acoustic barrier fencing on roads is funded.
Answer
If an Environmental Statement for a major road construction scheme identified noise as a potentially significant environmental issue, a noise management solution such as an acoustic barrier fence would be provided by the major road scheme.
The Transportation Noise Action Plan identifies Candidate Noise Management areas (CNMAs) across the existing major road asset. Each CNMA will be reviewed to determine if it should become a Noise Management Area (NMA). NMAs are locations where noise management interventions could be applied on a prioritised basis during existing maintenance and improvement programmes, where reasonably practicable. Budget provision would come from the maintenance and improvement programme.

To ask the Scottish Government what legislation it plans to amend or introduce to prevent cases of alleged domestic abuse being treated as family matters within the civil courts.
Answer
The Scottish Government is committed to reviewing the Children (Scotland) Act 1995 which makes provision about family matters, such as contact and residence, which are dealt with in the civil courts. That review will consider if further measures need to be taken to protect vulnerable parties in cases where domestic abuse is alleged.

To ask the Scottish Government for what reason trees, which have acted as a natural sound barrier at residential properties along the M74 embankment, are being felled.
Answer
Trees can provide some visual screening from a road. Although felling is necessary in certain locations along the M74 to allow the construction of an additional lane on the upgraded route, new planting will be provided to mitigate the loss of those trees as part of the M8 M73 M74 Motorway Improvements Project.
