To ask the Scottish Government what its position is on the figures published in the Summary Statistics for Schools in Scotland, No 4: 2013 that suggest that the number of pupils with additional support needs is equivalent to 19% of the school population, and whether it considers that the decline in the number of teachers since 2010 leaves sufficient capacity for schools to deal with this.
Answer
The Scottish Government is clear that the statistics indicate that there continues to be improved recording of children and young people with additional support needs in Scotland. The statistics also indicate that the pupil teacher ratio in local authority schools remains at the 2011 level of 13.5. This is the second year this has been maintained.
The report to Parliament on the implementation of additional support for learning will be published in February 2014 and will provide information on how well children and young people’s learning needs are met.

To ask the Scottish Government whether it will publish the destinations of school leavers with additional support needs in (a) 2009-10, (b) 2010-11, (c) 2011-12 and (d) 2012-13.
Answer
Information on the destinations of school leavers with additional support needs from the school years 2009-10, 2010-11, 2011-12 is already published. Information on the destinations of school leavers from the 2012-13 school year will be published in June 2014.
Information on secondary and special school leavers from publicly funded schools in Scotland by reason for support and initial destination category in 2011-12 is published in table L4.1 of the supplementary dataset to the Summary statistics for attainment, leaver destinations and healthy living, No. 3: 2013 Edition publication. The figures are as follows:

To ask the Scottish Government whether the Law Officers have given an opinion on the policy in the white paper on independence of charging UK students tuition fees.
Answer
The white paper is consistent with and informed by legal advice the Government has received. It is the long-standing practice of the Scottish and UK Governments, as is recognised in their respective Ministerial Codes, not to disclose the fact or content of advice from the Law Officers other than in the most exceptional circumstances.

To ask the Scottish Government whether the replacement of MV Hamnavoe with MV Helliar on the Stromness to Scrabster route in January 2014 is compliant with the terms of the contract that it signed with Serco in 2012.
Answer
The replacement service that will be provided in January 2014, is compliant with the terms of the public service contract signed between Scottish Ministers and Serco Limited.
The contract requires the operator to provide a suitable replacement vessel to undertake the service between Scrabster and Stromness during periods of Scheduled Unavailability. On this occasion, the operator has fully demonstrated that, although they have sought to charter a suitable Ro-pax vessel, using international searches through shipbrokers, the scarcity of such charter tonnage means that the operator now intends to utilise the MV Helliar as the replacement vessel to provide all the freight services and some of the passenger services. This is compliant with the contract and contingency arrangements for such periods of scheduled unavailability.

To ask the Scottish Government whether Pentland Ferries will be entitled to a proportion of the subsidy paid to Serco under the terms of the Northern Isles ferry contract during January 2014 when it fulfils requirements for lifeline passenger ferry services across the Pentland Firth.
Answer
No. Pentland Ferries will gain commercial benefit from the additional traffic carried during this period.
The MV Helliar is able to carry all expected freight vehicles and up to 12 passengers. Serco NorthLink Ferries held constructive dialogue with Pentland Ferries to ensure that ferry connectivity was maintained during this period of scheduled unavailability. Pentland Ferries has confirmed to Serco NorthLink Ferries that they are able to accommodate the overall travel demand across the Pentland Firth during this period. Serco NorthLink Ferries are providing courtesy buses between Scrabster and Gills Bay and Stromness and St Margaret’s Hope to minimise any inconvenience to passengers. It is anticipated that the effective liaison between both operators will continue to ensure effective connections to and from Orkney.

To ask the Scottish Government how many times people have been prevented from accessing the Air Discount Scheme because their journey was for non-personal reasons since the regulations were changed to prevent the scheme being used for business travel.
